Role of The American Arbitration Association | Dispute resolution between countries in Outsourcing

Role of The American Arbitration Association in Dispute resolution between providers across country:

Many of the outsourcing companies in other countries will enter into agreement / SLA with a US based companies for providing outsourcing services which may be binding on both the parties but many of the US companies prefer to have the dispute settled at their own state jurisdiction and expect legal cost incurred in this connection to be born ed by the other party. There are thousands of mid and small IT / ITES providers in other countries like India, Philippines, china etc but it will not be a feasible option for service providing companies to file a suit which may be for non-payment for service rendered, lack of quality in service , or any breach of contract, breach of confidentiality or violation of any terms in their contract.

In such situation The American Arbitration Association will play a crucial role.

The American Arbitration Association® (AAA), with its long history and experience in the field of alternative dispute resolution, provides services to individuals and organizations who wish to resolve conflicts out of court.

The AAA role in the dispute resolution process is to administer cases, from filing to closing. The AAA provides administrative services in the U.S., as well as abroad through its International Centre for Dispute Resolution® (ICDR). The AAA's and ICDR's administrative services include assisting in the appointment of mediators and arbitrators, setting hearings, and providing users with information on dispute resolution options, including settlement through mediation. Ultimately, the AAA aims to move cases through arbitration or mediation in a fair and impartial manner until completion.

Additional AAA services include the design and development of alternative dispute resolution (ADR) systems for corporations, unions, government agencies, law firms, and the courts. The Association also provides elections services as well as education.
